  1. About our Terms
    1. This website, (all referred to in these Terms as the "ProfitAbility Website") is operated by ProfitAbility Business Simulations Ltd, incorporated and registered in England and Wales with company number 04490565 whose registered office is at The Wooden Barn, Little Baldon, Oxford, Oxfordshire, England, OX44 9PU ("ProfitAbility").
    2. These terms and conditions ("Terms") apply to your use of the ProfitAbility Website.
    3. When certain words and phrases are used in these Terms, they have specific meanings (those words and phrases are known as "defined terms"). Where a defined term is used, it has the meaning given to it in the section of these Terms where it was defined (you can tell a term is a defined term because it will be in bold text and surrounded by speech marks).
    4. You should read these Terms carefully before using the ProfitAbility Website.
    5. By accessing or using the ProfitAbility Website you agree to be bound by these Terms.
    6. If you do not agree with or accept any of these Terms, you should stop using the ProfitAbility Website immediately.
    7. In these Terms, references to "we, our, us" and similar expressions are references to ProfitAbility. When we refer to "you" or "your" we mean:
      1. you, the person accessing and using ProfitAbility Website; and
      2.  the business on whose behalf you are acting.
    8. Please note that in accessing the ProfitAbility Website you are presumed to be acting for purposes relating to your trade, business, craft or profession.  
    9. If you are acting on behalf of your employer or another business when you access and use the ProfitAbility Website, you warrant that:
      1. you have full legal authority to bind your employer or that business; and
      2. you agree to these Terms on behalf of your employer or the business you represent.

Terms of Use

  1. Use of the ProfitAbility Website
    1. You may not use the ProfitAbility Website:
      1. in any way that violates any applicable laws;
      2. in any way that violates these Terms;
      3. in any way that violates ProfitAbility's, or any third party's, rights (including intellectual property rights);
      4. to transmit, or procure the sending of, any advertising or promotional material without our prior written consent;
      5. to impersonate or attempt to impersonate any other user or entity; and/or
      6. to engage in any other conduct that adversely affects or interferes with any other user's use of the ProfitAbility Website, or which may harm ProfitAbility or users of the ProfitAbility Website, or expose them to liability.
    2. You shall not: (a) misuse the ProfitAbility Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful; (b) attempt to gain unauthorised access to the ProfitAbility Website; or (c) otherwise attempt to influence or interfere with the functionality of the ProfitAbility Website.
    3. You agree that you are solely responsible for all costs and expenses you may incur in relation to your use of the ProfitAbility Website.

  2. Your privacy and personal information
    1. Your privacy and personal information are important to us. Any personal information that you provide to us via the ProfitAbility Website will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities in the event you have a query or complaint about the use of your personal information.

  3. Ownership, use and intellectual property rights
    1. The ProfitAbility Website and all intellectual property rights in it including but not limited to any information, data, materials or other content that is provided or made available on the ProfitAbility Website are owned by us, our licensors or both (as applicable). Intellectual property rights means rights such as: copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world). We and our licensors reserve all of our rights in any intellectual property in connection with these Terms. This means, for example, that we and they remain owners of them and are free to use them as we and they see fit.
    2. Nothing in these Terms grants you any legal rights in the ProfitAbility Website other than as necessary to enable you to access the ProfitAbility Website. You agree not to adjust, to try to circumvent, or to delete any notices contained on the ProfitAbility Website (including any intellectual property notices) and in particular in any digital rights or other security technology embedded or contained within the ProfitAbility Website.

  4. Accuracy of information and availability of the ProfitAbility Website
    1. Content on the ProfitAbility Website is provided for your general information purposes only and to inform you about us and our products and news, features and services. While we try to make sure that the ProfitAbility Website is accurate, up-to-date and free from bugs, we cannot promise that it will be. Furthermore, we cannot promise that the ProfitAbility Website will be fit or suitable for any purpose. Any reliance that you may place on the information on the ProfitAbility Website is at your own risk.
    2. While we try to make sure that the ProfitAbility Website is available for your use, we do not promise that the ProfitAbility Website is available at all times nor do we promise the uninterrupted use by you of the ProfitAbility Website.

  5. Disclaimers
    1. The ProfitAbility Website is provided on an "as is, as available" basis. To the fullest extent permitted by law, we disclaim all warranties, including the warranties of satisfactory quality, fitness for a particular purpose and non-infringement. We disclaim all responsibility and liability for: (a) any errors in or omissions on the ProfitAbility Website including, but not limited to, technical inaccuracies, errors, mistakes or typographical errors; (b) the unavailability of the ProfitAbility Website; (c) your use of the ProfitAbility Website; or (d) your use of any equipment or software in connection with the ProfitAbility Website.
    2. The above clauses do not apply in respect of any warranty or liability that cannot be limited or excluded under applicable law.

General Terms

  1. Limitation of liability
    1. Subject to clause 7.2, the following sub-clauses apply:
      1. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: (a) your use of, or inability to use, the ProfitAbility Website; or (b) your use of or reliance on any content displayed on the ProfitAbility Website.
      2. In particular, we will not be liable for: (a) loss of profits, sales, business, or revenue; (b) business interruption; (c) loss of anticipated savings; (d) loss of business opportunity, goodwill or reputation; or (e) any indirect or consequential loss or damage.
    2. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. For instance, we do not exclude liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

  2. Changes to these Terms or the ProfitAbility Website
    1. We reserve the right to vary these Terms from time to time. Each time you wish to use the ProfitAbility Website, please check these Terms to ensure you understand the terms that apply at that time. We may also update and change the ProfitAbility Website from time to time to reflect changes to our products, our users' requirements or our business plans.

  3. Governing law
    1. Your use of the ProfitAbility Website will be subject to the exclusive jurisdiction of the English Courts and will be governed by English Law.
